MV-2025-013 <br /> MLRB Hearing Withdrawal <br /> Dear Mr. Duckels, <br /> The Division of Reclamation, Mining and Safety (Division) received the past due annual report, fee, <br /> and map for the Bettger Gravel Pit, M-1976-051, permit on August 11, 2025. Therefore,this item has <br /> been withdrawn from the agenda for the August 20-21,2025,Mined Land Reclamation Board meeting. <br /> This means the enforcement hearing described in the Division's July 11, 2025, Notice of Violation <br /> (NOV) letter has been vacated. However, the Division has not received the Civil Penalty that was <br /> assessed in the NOV letter sent to you on July 11, 2025. The Civil Penalty due is $791.00 for a 112c <br /> operation. <br /> The violation described in the Division's NOV letter cannot be abated until the Division receives the <br /> required Civil Penalty, which should be submitted in the form of a check with the permit number(M- <br /> 1976-051) and the violation number (MV-2025-013) written on the check. The Civil Penalty must be <br /> submitted by check and made payable to "Division of Reclamation, Mining and Safety". <br /> Please be advised, the Civil Penalty assessed for Violation No. MV-2025-013 in the amount of <br /> $791.00, has not been vacated, and is due at this time.
