Therefore, the Division believes Arboles Sand & Stone, LLC (the <br /> "Operator") is in violation of C.R.S. § 34-32.5-117(6)(a), Rule 4.1(7), and Permit No. M-2013- <br /> 066 for failure to maintain the financial warranty in good standing for the entire life of the <br /> permit. <br /> Therefore, the Division has reason to believe that a violation exists to the Colorado Land <br /> Reclamation Act for Extraction of Construction Materials, C.R.S. § 34-32.5-101 et seq., and <br /> have scheduled this matter to appear before the Mined Land Reclamation Board ("MLRB" or <br /> "Board"). <br /> First, a Formal Public Hearing will be held during the November 12-13, 2025,Board Meeting <br /> for consideration of this possible violation.
