M-2016-009 <br /> Dear Sir, <br /> I am writing this letter in regards to our gravel property lease with regards to paragraph <br /> 11, terminations. There is an ongoing breach of contract which I must give written notice <br /> of 30 days to rectify this situation before termination. <br /> Reasons for the breach of contract: <br /> 1. The company never installed access gate on our property when the road was built. <br /> In addition to the breach of contract,there is intention of amending the contract which <br /> would further breach our current contract agreement. <br /> 2. Lack of mining of material. We did not ask for a Minimum annual payment <br /> because in the negotiations with John Paul Ary the amount of material to be <br /> hauled would depend on the final permit approved by the Pueblo County <br /> commissioners. The Special Use Permit, SUP#..., of Pueblo County you are <br /> allowed to haul 75 loads per day weather permitting,Monday through Friday and <br /> there has been no activity since March 2025. <br /> 3. In a discussion with Tony Mica,he stated the companies intention to amend the <br /> permit to allow crushing and separation on the sight. This flies directly in the face <br /> of the special use permit from Pueblo County. <br /> 4. Amending the permit would have direct financial implications to us. We <br /> negotiated a reduced royalty payment due to all materials being hauled out. Our <br /> original agreement for haul route royalties of$.17 per ton was lowered to$.10 per <br /> ton based on the fact there will be larger tonnages of simply raw materials. <br />
