Acreage Release Request (AR-1) Partial Acreage Reduction Request Dear Richard Coulson: On April 30, 2025 the Division of Reclamation, Mining and Safety concluded its review of the Acreage Release Request application submitted to the Division on March 5, 2025, addressing the following: A partial Acreage Release request of 1.83 acres of land owned by CDOT, and 10.07 acres of land owned by Randy Kirtright and the O’Brien Trust. The decision reached by the Division is: Partially approve. Based on the observations made during the inspection the request for partial release, 1.83 acres of CDOT owned land, of the permitted area, will be approved. The partial release request of 10.07 acres in the southern permit area will be denied. The release of 1.83 acres will reduce the permit area to 77.97 acres from 79.8 acres. The denial is because the release request involves portions of Pond 2 side slopes that are not at the required 3H:1V slope and the Division’s concerns regarding access to these areas. In accordance with Rule 4.17.2(5), the Division is required to wait thirty (30) days from this notice to allow for appeal of the Division’s decision. Once this period closes, if no appeal is submitted, the Division’s decision will be final. The permit area was reduced to 77.97 acres, through the release of -1.83 acres in this permit action. Because the permit is not totally released, you are still liable for filing annual reports and fees. Please submit a Technical Revision and update the mining and reclamation plan maps to depict the reduced permit area. Bond Held: $58,400.00
