The application submitted is for a 110(2)permit.but the commodities proposed to be mined <br /> (Silver, Lead, Zinc.Gold and mineral specimens)arc more typically associated with a <br /> Designated Mining Operation(DMO),as defined by Rule 1.1(19).owing to the inherent <br /> toxicity of these materials. A DMO of this scale(affecting less than 10 acres)would require <br /> a 110(d)permit. <br /> The proposed mining operation is primarily after silver ore and silver mineral specimens and does <br /> not include any gold. Lead and Zinc are by products of the silver ore and will not be processed at the <br /> proposed permit area but off site at an appropriate facility only when high grade ore is encountered. <br /> Please demonstrate,with reference to Rule 1.1(19)(f)(1),why the proposed operation <br /> does not"have a potential to produce acid or toxic mine drainage in quantities <br /> sufficient to adversely affect any person,property or the environment". <br /> (f) (1) Metal mining operations, permitted under Section 34-32-110, <br /> C.R.S. 1984, as amended, which do not use or store designated <br /> chemicals, shall be excepted from the requirements applicable to <br /> Designated Mining Operations, unless they have a potential to produce <br /> acid or toxic mine drainage in quantities sufficient to adversely affect any <br /> person, property or the environment. It shall be the burden of the Operator <br /> or Applicant to demonstrate to the satisfaction of the Office that such <br /> potential does not exist. <br /> The Proposed Mining Operation does not include the storage or use of any chemicals and should be <br /> exempt from being a Designated Mining Operation. <br /> The Existing Mining Operations under Prospecting permit P1992029 and Proposed Mining <br /> Operations do not produce any mine drainage nor does the Ore body produce any acid or toxic <br /> drainage. <br /> "Acid and Toxic Producing Materials"means natural or reworked earth materials having <br /> acid or toxic chemical and physical characteristics that, under mining or post-mining <br /> conditions of drainage, exposure, or other processes, produce materials which contain <br /> detrimental amounts of chemical constituents such as acids, bases, or metaic <br /> compounds. <br /> The Proposed Mining Operation will be extracting the Red Cliff Dolomite member of the <br /> Mississippian Leadville Limestone that contains silver deposits-neither the Dolomite or Limestone <br /> materials contain any acid or toxic chemicals. No materials will be stockpiled or left above ground <br /> during mining or post mining. <br />
