COLORADO <br /> Division of Reclamation, <br /> ® Mining and Safety <br /> Department of Natural Resources <br /> September 18, 2024 <br /> Bernard (Joe) Montoya <br /> White Wolf Construction & Landscaping, LLC <br /> 24541 Highway 12 <br /> Trinidad, CO 81082 <br /> Re: Notice of Continuance, White Wolf Construction Borrow Pit; Permit No. <br /> M-2018-029 <br /> Dear Mr. Montoya: <br /> The Division hereby provides notice that the hearing for the consideration of a violation <br /> of C.R.S. 34-32.5-117(a) for failing to maintain the financial warranty in good standing for <br /> the entire life of the permit; and for requesting the Board's affirmation for violation <br /> number MV-2024-015 (issued by the Division pursuant to C.R.S. 34. 32.5-124) for failure <br /> to submit the annual report, map, and fee as required per C.R.S. 34. 32.5-116(3)(a) and <br /> (b). These items have been continued from the September 18-19, 2024 Board meeting and <br /> will now occur during the October 16-17, 2024 Board meeting. If the Board finds a <br /> violation at this hearing, it may issue a cease-and-desist order pursuant to C.R.S. <br /> 34-32.5-124(2); suspend, modify, or revoke the permit pursuant to C.R.S. <br /> 34-32.5-124(6)(a); assess a civil penalty in the amount of $100.00 to $1,000.00 for each <br /> day of violation pursuant to C.R.S. 34-32.5-124(7); and/or find the financial warranty <br /> subject to forfeiture pursuant to C.R.S. 34-32.5-118(1). <br /> The Division requires the parties to submit the required annual report, map, and fee; the <br /> civil penalty payment of $200 issued as part of violation no. MV-2024-015; and provide <br /> documents verifying that the financial warranty is in good standing. The aforementioned <br /> items are due by October 3, 2024. Failure to provide these items by October 3rd will result <br /> in a hearing to revoke the permit during the October 16-17, 2024 Board Hearing.
