Grand Ave, Ste 250 <br /> Montrose, CO 81401 <br /> Re: New Horizon North Mine (Permit No. C-2010-089) <br /> Bond Release Application No. 4(SL-4) <br /> Dear Montrose County Commissioners: <br /> This letter, as required by Rule 3.03.2(5)(a) of the Rules and Regulations of the Colorado Mined <br /> Land Reclamation Board for Coal Mining, is to inform you that the Division of Reclamation, <br /> Mining and Safety has issued a proposed decision to approve Bond Release Application No. 4 for <br /> the New Horizon North Mine. This decision will be published in the San Miguel Basin Forum as <br /> soon as possible. The first day following publication of the notice initiates a thirty (30) day public <br /> comment period. If, within thirty days, there are no requests for an adjudicatory hearing, the <br /> decision will become final. <br /> The Division proposes to approve Phase I release on 35.2 acres. 34 acres were backfilled and <br /> graded in the western, southern and eastern portions of the permit area to support the post mining <br /> land use of dryland pasture. The remaining 1.2 acres are associated with a light use road and a <br /> discharge pipe underneath AA Road in the southwestern permit area that are approved to remain <br /> as permanent post mining features at the request of the landowners. The Division also proposes <br /> to approve the Phase II and Phase III release on 1.2 acres associated with the light use road and <br /> discharge pipe underneath AA Road in the southwestern portion of the permit area. As an <br /> interested party, you have the right to an adjudicatory hearing as outlined under Rule 3.03.2(6) of <br /> the Rules and Regulations. The request for an adjudicatory hearing must be written and state with <br /> specificity the reasons why the hearing is requested.
