COLORADO
• \/ Division of Reclamation,
® Mining and Safety
Department of Natural Resources
1313 Sherman St. Room 215
Denver, CO 80203
February 2,2024
Devon Glosser
BURNCO Colorado LLC
10100 Dallas St
Henderson CO 80640
RE: DRMS Permit M2003-001;Nissan Farm Resource; Technical Revision 3 (TR3)—
Adequacy Review Letter 1
Mr. Glosser:
The Division of Reclamation, Mining and Safety received Technical Revision 3 (TR3) for
the above listed permit on January 26, 2024. This revision was submitted as required to
comply with a corrective action required by the site inspection conducted on November 15,
2023. The decision date for this revision has been set for February 26, 2024. DRMS has
completed the initial adequacy review of TR3, and as with most revisions, there are several
items that will require clarification of the existing information or submittal of additional
information.
Please be advised that if you are unable to satisfactorily address any concerns identified in
this review before the current decision date of February 26, 2024, it will be your
responsibility to request an extension of the review period. If there are outstanding issues
that have not been adequately addressed prior to the end of the review period, and no
extension has been requested, the Division must deny this revision. Denial of this revision
will not remove the requirement to update the mining and reclamation plans as noted in the
November 2023 Site Inspection.
TR3, as submitted, proposes several modifications to the existing approved mining and
reclamation plans, provides updated maps for the mining and reclamation plans, and updates
the associated reclamation bond amount.
1) Proposed updates to Mining Plan: DRMS has no issues with the mining plan
updates as proposed in TR3. These updates will become part of the approved mine
plan upon approval of TR3.
OF'HOC
1313 Sherman St. Room 215 Denver, CO 80203 P(303)866-3567 F(303)832-8106 https://colorado.gov/drms
Jared Polis, Governor I Dan Gibbs, Executive Director I Michael Cunningham,Acting Director
K1876*
