COLORADO
® Division of Reclamation,
Mining and Safety
Department of Natural Resources
June 7, 2023
Caleb Kirkpatrick and Lisa Noon
5128 Neeper Valley Road
Manitou Springs, CO 80829
RE: Not Yours Lode Claim, Permit No. M-2023-020;
Need for State Mine Reclamation Permit
Dear Caleb and Lisa:
The Colorado Division of Reclamation, Mining and Safety (DRMS) has specific Rules and
Regulations for Hard Rock, Metal, and Designated Mining Operations, adopted by the Colorado
Mined Land Reclamation Board. These rules are in accordance with the Colorado Mined Land
Reclamation Act (Title 34 Article 32). It has come to the attention of the DRMS that you may be
conducting mineral operations at your claim that requires a mine reclamation permit. The
DRMS has assigned permit ID number M-2023-020 to your claim. Please reference this Permit
ID number on any correspondence you submit to the Division.
As defined in the Act (34-32-103(8)), "mining operation" means the development or extraction
of a mineral from its natural occurrences on affected land. These activities would need an
approved mine reclamation permit with the DRMS.
As defined in the Act (34-32-110), Any person desiring to conduct limited mining operations
may apply for the expedited processing of a mine reclamation permit under two categories:
110(1) —for operations on less than five acres; or 110(2) —for operations on less than ten acres.
Both categories limit material extractions to less than 70,000 tons of mineral or overburden or
combination of the two per calendar year.
An approved reclamation permit is required prior to conducting any mineral mining activities on
your claim. If you have any questions regarding whether your activities require a reclamation
permit, please contact Michael Cunningham at the DRMS (303) 866-3567 x 8116.
w°F Ic
Physical: 1313 Sherman Street, Room 215, Denver, CO 80203 P 303.866.3567 F 303.832.8106 Fe
Mailing: DRMS Room 215, 1001 E 62nd Ave, Denver, CO 80216 https://drms.colorado.gov
Jared S.
