<br /> Dear Sir or Madam:
<br /> The Colorado Division of Reclamation, Mining and Safety is proposing to approve a renewal
<br /> application for coal mining and reclamation permit. The application was submitted by Mountain
<br /> Coal Company, LLC on January 27, 2021 for the West Elk Mine. In accordance with Rule
<br /> 2.08.5(3)(b)of the Rules and Regulations of the Colorado Mined Land Reclamation Board for Coal
<br /> Mining,we are providing notice of this proposed decision.
<br /> Any person with an interest which may be adversely affected by the proposed decision may request
<br /> a formal hearing before the Mined Land Reclamation Board within 30 days of date following the
<br /> first publication of the public notice by the Division in the Delta County Independent.
<br /> The underground mine is located approximately 9 miles East of Paonia, Colorado. The permit area
<br /> is further described as follows:
<br /> All or portions of Sections 9 through 36 (inclusive), Township 13 South, Range 90 West; Sections
<br /> 23 through 26 (inclusive), Township 13 South, Range 91 West; Sections 1, 2, 3, 4, 5, 8, 9, 10, 11,
<br /> 12, 14, 15, 16,21,22 and 23,Township 14 South, Range 90 West; all of the 6th Principal Meridian.

<br /> and Recorder, 221 N. Wisconsin, Gunnison, CO 81230. A Copy of the Division's"Proposed
