<br /> <br /> <br /> <br /> <br /> <br />June 10, 2022 <br /> <br /> <br />Brian Wells <br />Dirt Merchant, Inc. <br />638 1800 Road <br />Delta, CO 81416 <br /> <br /> <br />Re: Wells Pit - File No. M-2006-027 <br /> Dirt Merchant, Inc. <br /> Amendment Application (AM-1) <br /> Dirt Merchant Inc. proposes a revision to their permit application to revise the <br />reclamation plan. <br /> <br />Dear Brian Wells: <br /> <br />On June 10, 2022 the Division of Reclamation, Mining and Safety concluded its review of the <br />Amendment application submitted to the Division on October 4, 2021, addressing the following: <br /> <br />We would like to extend for 1 yr the time on our pit to allow for the completion of reclamation and <br />also would like to change the reclamation area to a hay storage and equipment parking area not <br />seeded dry land <br /> <br />The decision reached by the Division is: approve. The Division of Reclamation, Mining and Safety <br />herby approves Dirt Merchant, Inc.’s ammendment application to change the Wells Pit post mining <br />land use to general agricultural. The application meets the requirements of the regulations of the <br />Colorado Mined Land Reclamation Act and the rules and regulations of the Colorado Mined Land <br />Reclamation Board. <br /> <br />The terms of Amendment No. 1 approved by the Division are hereby incorporated into Permit No. M- <br />2006-027. All other conditions and requirements of Permit No. M-2006-027 remain in full force and <br />effect. <br /> <br /> <br />Bond Held: $14,289.17 <br />Prior Liability: $14,289.17 <br />Change in Liability: ($3,227.17) <br />Revised Liability: $11,062.00 <br />Prior Permit Acreage: 8.50 <br />Change in Permit Acreage: 0.00
