Outstanding items are addressed below. <br /> • Page I of the application form states that the change in acreage is 63.4 acres. However, <br /> based on the submitted maps and the use of aerial photographs, it is not clear to the <br /> Division where this acreage is located. The fields west of the existing permit area(where <br /> expansion is planned) appear to only account for approximately 30-35 acres. Please <br /> explain where the other acreage is located. <br /> The currently approved affected and permit area is 81.5 acres, according to CDRMS records. <br /> Amendment 01 adds 63.4 acres to that area. This 63.4 acres is a combination of the new mining <br /> areas on the west side of Map C-1 and miscellaneous areas within the affected area of the existing <br /> permit. The affected area of the approved permit only covers the mining phases delineated in the <br /> existing mining plan. This is an oversight, as in between the mining phases are affected areas. The <br /> amendment corrects this oversight by aligning the affected area with a simple permit boundary <br /> similar to the property lines. <br /> A copy of the original Exhibit C, annotated to highlight the previously permitted areas. <br /> • Please re-submit page I of the application form with the operation name Delta Paving <br /> Gravel Pit. That is the official name for permit#M-1998-105. <br /> See the attached revised application form. <br /> • Also on page I of the form, the end use for the sand and gravel should be listed under Item <br /> #S. <br /> See the attached revised application form. <br /> • Please re-submit page 6 of the application without initialization of the final item (#10) or <br /> submit documentation of a power of attorney related to a joint venture or partnership. <br /> See the attached revised application form. <br /> Delta Paving <br /> May 2022 Lewicki&Associates <br />
