Our initial review indicates that all preliminary items required by Rule 2.08.4(5) have <br />not been submitted. Thus, your application is incomplete for the purposes of filing as of November <br />3, 2021. <br /> <br />With TR-76, New Elk Coal Company, LLC (NECC) is proposing a new haul road. However, the <br />extent of the haul road proposed with the submission does not include the full length of the road <br />NECC is upgrading/constructing. Based on the October 13, 2021 site inspection and further <br />discussion with NECC staff, the haul road will extend east outside of the current disturbance and <br />permit boundary and connect to an established road. NECC will need to revise the Technical <br />Revision to address the full length of the road to where it connects to an established public road. <br /> <br />Application Form <br /> <br />The application form does not indicate there is a change in disturbed, permit, or affected area. This <br />does not appear to be accurate given the extent and length of the haul road. Please revise this as <br />necessary. <br /> <br />Update Section 2.04 <br /> <br />Please submit the minimum requirements for information on environmental resources required by <br />Rule 2.04 for any new proposed disturbed and affected area associated with the haul road. <br />
