To date, Highbury has failed to respond to the <br /> Division's request. The Division now requires that Highbury provide an update to the Division <br /> of Highbury's plans to complete final reclamation of the sites. <br /> On February 3, 2020 Cotter Corporation notified the Division that the above listed sites were in <br /> final reclamation and that Highbury would acquire the permits through the Succession of <br /> Operators(SO) application process. The SO applications have been processed and Highbury is <br /> now the Operator. <br /> Pursuant to C.R.S. 34-32-116 (7)(q) all reclamation of the sites shall be completed within 5 years <br /> from the date the Operator notified the Mined Land Reclamation Board(Board)that final <br /> reclamation commenced. Therefore, final reclamation of the sites must be completed by <br /> February, 3,2025. <br /> At the following three sites, C-LP-21 Mine(M-1977-305),CM-25 Mine (M-1977-307), and SR- <br /> 13A Mine (M-1977-311),reclamation is largely completed and the sites could be considered by <br /> the Division for release from further reclamation responsibility at the request of the Operator. <br /> Please evaluate the current reclamation status of these three sites and notify the Division <br /> within 30 days that reclamation is complete or provide a schedule for completing any <br /> remaining reclamation activities necessary to complete final reclamation.
