`o COLORADO ® d Division of Reclamation, Mining and Safety Department of Natural Resources 1313 Sherman St. Room 215 Denver, CO 80203 June 2,2021 Delta County Commissioners County Commissioner 501 Palmer Street, 9227 Delta, CO 81416 Re: West Elk Mine (Permit No. C-1980-007) Bond Release Application No. 12 (SL-12) Dear Delta County Commissioners: This letter, as required by Rule 3.03.2(5)(a) of the Rules and Regulations of the Colorado Mined Land Reclamation Board for Coal Mining, is to inform you that the Division of Reclamation, Mining and Safety has issued a proposed decision to approve Bond Release Application No. 12 for the West Elk Mine. This decision will be published in the Delta County Independent as soon as possible. The first day following publication of the notice initiates a thirty (30) day public comment period. If, within thirty days, there are no requests for an adjudicatory hearing, the decision will become final. With the approval of SL-12,Mountain Coal Company is released from Phase I reclamation liability on a total of 22.58 acres in the Dry Fork of the Minnesota Creek area, including the plugging and abandonment of 31 Mine Ventilation Boreholes (MVBs) on the E-4, -5 and -6 longwall panels, nine exploration drill holes (five of which were converted to MVBs) and nine monitoring wells; the backfilling and regrading of 26 drill pads,and the backfilling and regrading of seven associated road segments. The reclamation work was completed between 2016 and 2018. As an interested party, you have the right to an adjudicatory hearing as outlined under Rule 3.03.2(6) of the Rules and Regulations. The request for an adjudicatory hearing must be written and state with specificity the reasons why the hearing is requested. The request must be received within thirty days of the day following the first publication of the proposed decision in the Delta County Independent.
