Enclosed is the Division's decision form and written findings. The proposed
decision will be published in the Delta County Independent, as soon as possible. The first day
following publication of the notice initiates a thirty-day public comment period. If there are no
requests for an adjudicatory hearing within the thirty days, the decision will become final.

With the approval of SL-12, Mountain Coal Company is released from Phase I reclamation liability
on a total of 22.58 acres in the Dry Fork of the Minnesota Creek area, including the plugging and
abandonment of 31 Mine Ventilation Boreholes (MVBs) on the E-4, -5 and -6 longwall panels,
nine exploration drill holes (five of which were converted to MVBs) and nine monitoring wells;
the backfilling and regrading of 26 drill pads, and the backfilling and regrading of seven associated
road segments. The reclamation work was completed between 2016 and 2018. As provided by
Rule 3.03.2(6), should you object to the Division's proposed decision, you may request an
adjudicatory hearing.

If you have questions or are in need of additional information, please contact me.
