The CDRMS letter identified that select areas <br /> in Release Area C were still in use, and these areas had been incorrectly included in the <br /> requested permit release area. This response updates Release Area C, removing the select areas <br /> from the requested permit release area. These updates include updating the narrative and <br /> corresponding maps. <br /> Permit Reduction <br /> As previously stated in the December 15, 2020 release request, the Permit Area is currently <br /> 736.92 acres and is shown on Exhibit 1. BMRI requests to reduce the Permit Area by 308.7 <br /> acres. The requested release areas are divided into Areas A, B, C, and D (Exhibit 1). Area A <br /> consists of 59.0 undisturbed acres and the previously reclaimed "Waste Rock B" area which is <br /> 18.0 acres, totaling 77.0 acres. Area B consists of the unpaved haul road from the water <br /> treatment facility to the TSF totaling 9.5 acres. Area C includes the remaining reclaimed "South <br /> Waste Rock" area which is 1.4 acres, 24.5 acres of undisturbed lands, and 6.2 acres of the "Mill <br /> Area", totaling 32.1 acres. Area D consists of 166.2 acres of undisturbed lands surrounding the <br /> west and southern perimeter of the TSF, 17.6 acres in the designated TSF area that was <br /> undisturbed, and 6.3 acres in the "Mill Area"totaling 190.1 acres. <br /> Waste Rock B, South Waste Rock, and the Mill Area have been reclaimed for a number of years <br /> and have been inspected and considered reclaimed by CDRMS. The Haul Road was declared an <br /> access easement in the 1997 plat survey included in Technical Revision 25 and is not required to <br /> be reclaimed. The plat survey is included as Exhibit 2. <br />
