Our initial review indicates that all preliminary items required by Rule 2.08.4(5) have not <br />been submitted. Thus, your application is incomplete for the purposes of filing as of October 30, <br />2020. <br /> <br />MR-453 presents a design for the restoration of a stream channel. This is beyond the scope of a <br />Minor Revision, (per Rule 1.04(73), “Minor revision” means a modification in permit provisions to <br />reflect minor alterations in the location of roads or other facilities within the permit area, minor <br />alterations in the timing or sequencing of mining or reclamation plans approved in accordance with <br />the requirements of these Rules or other minor alterations in surface coal mining and reclamation <br />operations which shall not cause a significant alteration in the permittee’s reclamation plan). <br /> <br />Please withdraw MR-453 and re-submit the material as a Technical Revision, as previously <br />discussed. <br /> <br />In accordance with Rule 2.07.3(1), you have the opportunity to amend, review, or otherwise make <br />your application complete. <br /> <br />If you have any questions, please contact me. <br />
