August 19, 2020 4ECFIV EID <br /> AUG <br /> Mr. Patrick Lennberg pt 2 12020 <br /> Colorado Division of Reclamation Mining and Safety A1gyA�C(q* <br /> TOV <br /> 1313 Sherman Street, Room 215 &47y <br /> Denver, CO 80203 <br /> Re: Permit Application M2019053 for Kelley Trucking <br /> Dear Mr. Lennberg, <br /> On October 7, 2019, I submitted a Colorado Open Records Act (CORA) request to Adams County requesting <br /> all information regarding Kelley Trucking's Permit(s) for the public—Watkins Road"addition that Kelley <br /> Trucking installed at 72"d Avenue as a private daily, driveway for Kelley/contractors'semi trucks moving <br /> daily mined land from the Southwest Quarter Section 6, Township 3 South, Range 64 Adams County <br /> through Section 1, Township 3, Range 65 Adams County. The Owners of parcel # 0181900000194 in <br /> Section 1, Township 3, Range 65 Adams County had yet to see a valid survey pertaining to our property <br /> that Kelley Trucking's new"public —Watkins Road" runs through to 72"d Avenue. <br /> On July 22, 2020, I received a response from my CORA request. Within the response the Adams County <br /> Community and Economic Development Department advised no permits have or had been issued to Kelley <br /> Trucking to do work in the County ROW (Right of Way) of Watkins Road. Additionally, the Adams County <br /> Public Works Department records reflect that there hasn't been any Right-of-Way dedications for Watkins <br /> Road south of 72"d Avenue and that portion of road is also not being maintained by the County. The <br /> attached documents specifically reflect this information. <br /> The Aztec Survey provided by Kelley Trucking references Road Petition No. 127 page 557 (included) for the <br /> Watkins Road Right-of-Way. Please see the last paragraph listing the Section 1, Township 3, Range 65 for <br /> which the Right-of-Way has not been granted and the land owners reimbursed loosing sums. In addition to <br /> the other documentation Adams County sent in the CORA response. <br /> Hence, it is in my opinion that Watkins Road does not exist south of 72"d Avenue and is not a public road as <br /> stated in Kelley Trucking's Permit Application Form and Mining Plan. On page 22 of Kelley Trucking's DRMS <br /> application, Kelley states that Watkins Road"appears"to be constructed in accordance with the Adams <br /> County Rural Residential Cross Section. This is a misleading statement because Kelley Trucking constructed <br /> this road so they know exactly how it was constructed, but seem to want to keep up a fagade that the road <br /> was an existing public road. I have personal knowledge that the two-way road/driveway was constructed by <br /> Kelley Trucking in June/July of 2019 (not the County). It is in my opinion that it cannot and should not have <br /> been constructed or used to haul semi's filled with dirt to their construction site from their mining operation. <br /> Sincerely, <br /> Danni Danko-Holloway <br /> Copy sent via USPS <br />
