Giles hereby represents to the State of Colorado, Department of Natural Resources, Division of Reclamation, Mining <br /> and Safety, that the undersigned is the owner, one of the owners, or represents the owner of the real property described in the <br /> table below, located in the County of Ouray and the State of Colorado. <br /> As such, the undersigned hereby grants to the agents, employees, and contractors of the Division of Reclamation, Mining and <br /> Safety, Department of Natural Resources, State of Colorado, permission to enter upon such lands to restore, reclaim, abate, <br /> control or prevent the adverse effects of past mining practices and to do all things necessary or expedient to protect the public <br /> health, safety or general welfare. Such activities are in the public interest. <br /> Consent is given to enter upon the above-described property for the length of time necessary to safeguard the mine openings <br /> in the manner described below. Inactive mine openings are inherently dangerous, unstable and subject to rapidly changing <br /> conditions. During the construction phase such changing conditions may make it necessary to safeguard the opening(s) using <br /> an appropriate alternative abatement method. <br /> Feature ID Type of Feature Closure Method Legal Description <br /> 04 Adit Bat Grate Monster No 1 M.S. # 19795 <br /> 04a Shaft Grate Monster No 1 M.S. # 19795 <br /> It is understood and agreed that there will be no lien placed against the above-described property for reclamation work. The <br /> undersigned acquired title prior to May 2, 1977 and did not consent to, participate in or exercise control over the mining <br /> operation which necessitated the reclamation work. <br /> The landowner has an existing responsibility to insure that any abandoned or inactive mine openings located on his/her <br /> properties are adequately safeguarded and all present and subsequent landowners are required to maintain the mine closure <br /> after the work has been completed as outlined in C.R.S. 34-24-110(1).
