(Arcosa) Section 112 <br /> Construction Materials Reclamation Permit Amendment package for the Boulder Lightweight facility(Permit No. <br /> M-1988-108). We understand, based on your letter that the Division deemed the application incomplete.The <br /> following letter provides a response to the items that the Division identified as incomplete. In addition,Arcosa is <br /> resubmitting a complete permit amendment package for consideration by the Division. Attached please find one <br /> original and one copy of a revised application.The application fee was provided with our January submittal. <br /> We have organized the letter by the Division's comments, which are restated in italic fonts followed by <br /> Arcosa's response in normal font. <br /> Division Comment.EXHIBIT R-Proof of Filing with County Clerk and Recorder(Rule 6.4.1 a): <br /> You must submit an affidavit or receipt indicating the date on which the application was placed with the local <br /> County Clerk and Recorder. <br /> Arcosa Response: Arcosa filed a copy of its January 2019 application with the Jefferson County Clerk and <br /> Recorder soon on February 1, 2019. Proof of filing of the January 2019 permit amendment application with the <br /> Clerk and Recorder is provided in Exhibit R. As noted above, Arcosa is submitting an updated permit amendment <br /> application with this response and has provided a copy of the updated application to the Jefferson County Clerk <br /> and Recorder. Proof of filing of the updated application also is provided in Exhibit R of the attached revised <br /> application. <br /> Division Comment: EXHIBIT S-Permanent Man-Made Structures (Rule 6.4.19): <br /> Please note that roadways and above-ground or underground utilities (f present)within 200 feet of the proposed <br /> affected area are considered permanent man-made structures. In accordance with Rule 6.4.19, when mining <br /> operations will adversely affect the stability of any significant, valuable and permanent man-made structure <br /> located within 200 feet of the affected area, the applicant may either: <br /> (a) Provide a notarized agreement between the applicant and the person(s)having an interest in the <br /> structure, that the applicant is to provide compensation for any damage to the structure; or <br /> (b) Where such an agreement cannot be reached, the applicant shall provide an appropriate engineering <br />
