Binns OCT 2 2 2018 OCT 1 7 2018 <br />Environmental Protection Specialist Division of Reclamation, <br />Division of Reclamation, Mining and Safety Mining & Safety <br />1313 Sherman Street, Room 215 <br />Denver, CO 80203 <br />Re: Bowie No. 1 Mine (Permit No. C-1981-0388) Technical revision No. 64 ('I'R-64) Reclamation Plan, \Fest Mine Pond <br />Removal (S1IPO Project #67175) <br />Dear Ms. Binns: <br />Thank you for your correspondence dated October 3, 2018, received by our office on October 5, 2018 for the above referenced <br />protect submitted to our office pursuant to 36 CFR 800.4(d)(1). <br />As the above referenced permit revisions doe not propose additional surface disturbance outside of the currently approved <br />disturbance , it is our opinion that a finding of no historic properties affected is appropriate for the proposed undertaking pursuant <br />to 36 CFR 800.4(d)(1). <br />The consultation process does involve other consulting parties such as local governments and Tribes, which as stipulated in 36 <br />CFR 800.3 are required to be notified of the undertaking. Additional information provided by the local government, Tnbes or <br />other consulting parties may cause our office to re-evaluate our continents and recommendations. <br />If previously unidentified archaeological resources are discovered in the course of the protect, work must be interrupted until the <br />resources are properly evaluated in terms of the National Register of Historic Places eligibility criteria (36 CFR 60.4) to consultation <br />with our office. Should human remains be discovered during mining activities, the requirements under State law C.R.S. 24-80 <br />(part 13) apply and must be followed. <br />Thank you for the opportunity to comment.
