July 20, 2018 <br /> Stan Opperman <br /> APC Construction Co, LLC <br /> 14802 W 44" Ave <br /> Golden CO 80403 <br /> Re: Reason to Believe a Violation Exists and Notice of Board Hearing; <br /> Ralston Quarry; Permit M-1974-086 <br /> Mr. Opperman, <br /> On June 22, 2018, the Division conducted an inspection of the Ralston Quarry(Permit M-1974-086) and <br /> found the Operator had failed to report a landslide which occurred on June 10-11, 2018, affected off-site <br /> property, and rendered impassable an access road for Ralston Reservoir owned by Denver Water. <br /> Material removed from the landslide impacted area was also being stockpiled partly outside of the <br /> permitted area impacting an unpermitted area of approximately 5.25 acres. Pursuant to C.R.S. § 34-32.5- <br /> 123(2) an operator who mines substantial acreage beyond the approved permit boundary may be found to <br /> be operating without a permit. <br /> Based on the findings of the inspection we believe this is a violation of: <br /> • C.R.S. 34-32.5-121(2) and Rule 8.1 for failing to notify the office, as soon as reasonably practicable, <br /> but no later than 24 hours, after the operator has knowledge of a failure,or imminent failure of any <br /> impoundment, embankment, or stockpile or slope that poses a reasonable potential danger to persons <br /> or property. <br /> • C.R.S. 34-32.5-109(1) for failure to first obtain a reclamation permit from the Mined Land <br /> Reclamation Board or Office before engaging in a new mining operation as required. <br /> Therefore, the Division has reason to believe that a violation exists to the Colorado Land Reclamation Act <br /> for the Extraction of Construction Materials, C.R.S. § 34-32.5-101 et sue., and have scheduled this matter <br /> to appear before the Mined Land Reclamation Board. <br /> A Formal Public Hearing will be held during the August 22-23, 2018 Board Meeting for consideration of <br /> this possible violation. The hearing will be held at 1313 Sherman Street, Room 318, Denver, Colorado, <br /> beginning at 9:00 a.m. on August 22, 2018 or as soon thereafter as the matter can be considered.
