6/12/2018 State.co.us Executive Branch Mail - West Elk PR -15 Site Inspection and Informal Conference
STATE OF DRMS_CoalAdmin - DNR, DNR <dnr drms_coal_admin@state.co.us>
'r COLORADO
Stark - DNR, Jim <jim.stark@state.co.us> Tue, Jun 12, 2018 at 10:03 AM
To: Shannon Hughes<shughes@wildearthguardians.org>
Cc: Jason Musick <jason.musick@state.co.us>, Leigh Simmons <leigh.simmons@state.co.us>, DNR DRMS_CoalAdmin -
DNR <dnr—drms—coal—admin@state.co.us>
Shannon,
I just wanted to follow up on our phone conversation from yesterday afternoon. Regarding the request for a site
inspection the operator and the Division are fine with setting that up. There is, however, one item that is out of the
Division's jurisdiction and that is air quality standards. Because of our lack of jurisdiction, we will not be able to
accommodate you taking an air sample from any of the mine ventilation boreholes. We will be able to look at the
proposed Sunset Trail expansion area and the reclamation progression at the site. As we discussed, given our various
schedules and the Independence Day Holiday, we will need to conduct the inspection next week on either Thursday or
Friday (6/21 or 6/22). We can meet early next week to go over an inspection plan so we maximize our time in the field.
With regards to the Informal Conference, by Rule we are required to hold the conference on or before 7/2/2018. That
said, if all parties agree, we can hold it at a later date. As we discussed, the last week in July or first week in August
appears to be a good time for the conference. We can work on a date when we talk next week, as we will need to
reserve a space and we are required to publish a notice of the conference at least two weeks before the conference.
If you can let me know ASAP regarding next week's inspection and a good time to meet to work on an inspection plan
would appreciate it. Please let me know if you have any additional questions. Thanks and have a great day.
James R Stark
rli Ig 1and Safety
P 303.866.3567 ( C 720.724.0486 1 F 303.832.8106
1313 Sherman Street St., Suite 215, Denver, CO 80203
jim.stark@state.co.us ( http://mining.state.co.us
https://mail.google.com/mail/b/AOg3vwk9HMBKxYjXiTKP-AZVo_val37EbncQUwR1zIAxy5SNnRIL/u/O/?ui=2&ik=deb7fOcd20&jsver=k8XTJOJ1 kuE.en... 1/1
