LN 01
Ec,J OFFICE of ARCHAEOLOGY and HISTORIC PRESERVATION
RECEIVEDI
Leigh D. Simmons APR 20 2010 c
Environmental Protection Specialist 1 6 Z
Division of Reclamation, Mining and Safety Civision of ReCla WOns
1313 Sherman St., Room 215 MiffIng & SafeW
Denver, Colorado 80203
Re: West Elk Mine (Permit No. C-1980-007), Technical Revision No. 145 (TR -145) Revised MVP Pad and Road
Locations for Longwall Panel E8 (HC #68249)
Dear Mr. Simmons:
Thank you for your recent correspondence dated March 20, 2018 (received by our office on March 23, 2018)
regarding the subject undertaking.
A search of the Colorado Cultural Resource Inventory Database indicates that no cultural resource inventories
have been conducted in the vicinity of the proposed area to be added to the existing permit and no cultural
resources eligible for or listed to the National Register of Historic Places have been recorded therein. Our files
contain incomplete information for this area and there is the possibility that as yet unidentified cultural resources
exist within the proposed permit area.
Because the proposed mining plan revision involves Federal oversight, and longwall mining creates the possibility
of subsidence which may impact historic properties (i.e. cultural resources which are eligible to be listed in the
National Register of Historic Places), please note that it is the responsibihty of the Federal agencies involved to
comply with Section 106 of die National Historic Preservation Act as set forth in 36 CFR Part 800 ("Protection
of Historic Properties"). This includes the identification of any historic properties within the area of potential
effects and determining whether the undertaking will have an effect upon such properties. The State Historic
Preservation Office, Native American tribes, representatives of local governments, and applicants for Federal
permits, licenses or other approval are entitled to consultative roles in this process
Thank you for the opportunity to comment. If we may be of further assistance, please contact Todd
McMahon, Staff Archaeologist at (303) 866-4607/todd.mcmahonp_state.co.us.
Sincerely,
Steve Turner, IA
State Historic Preservation Officer
ST/TCM
OFFICE OF ARCHAEOLOGY AND HISTORIC PRESERVATION
303-866-3392 * Fax 303-866-2711 * E-mail: oahp@state.co.us * Internet: www.historycolorado.org
