As we discussed, I am sending you this letter so you can reply to provide a <br /> clarification. <br /> Even though the March 261h letter contains wording such as "DRMS and WQCD have determined" <br /> and "This concludes the Division's adequacy review of TR-27."you confirmed to me during our <br /> conversation that DRMS has not reached any final decision on Climax's application for TR-27, and <br /> the letter does not set forth any final DRMS decision. <br /> The March 261h letter was intended to share some of the initial results of DRMS's adequacy review <br /> under Rule 1.4 and to present some issues for Climax to consider and respond to in support of <br /> DRMS's review. The letter is to be construed as part of a series of DRMS's typical communications <br /> regarding a pending application and not to convey a final decision. <br /> As we discussed, with this clarification Climax will study the issues you raise and look forward to an <br /> early meeting with DRMS to discuss them.
