1/10/2018 State.co.us Executive Branch Mail - Fwd: Bowie Permit Renewal
STATE OF DRMS_CoalAdmin - DNR, DNR <dnr drms_coal_admin@state.co.us>
'r
COLORADO
Dcpa,t, I1e'Al of NMU'al Resourc(rs
---------- Forwarded message ----------
From: Steve Harper <hotchlaw@gmail.com>
Date: Tue, Jan 9, 2018 at 11:01 AM
Subject: Bowie Permit Renewal
To: "Stark - DNR, Jim" <jim.stark@state.co.us>, Mark Shaffer <ranchbroker@tds.net>
Jim:
I am not totally familiar with the process involved, but it is my understanding that Bowie has requested a renewal of their
permit for Bowie No. 1. It is also my understanding that there are no indications that any changes are proposed regarding
reclamation. The Ditch Companies I represent would oppose any renewal of the permit if the matter of the reclamation of
the culvert is not adequately addressed.
In light of the engineering report that I emailed to you November 29, 2017, and in light of your previous statements that
the current reclamation plan requires the operator to remove the culvert carrying Farmers Ditch water on the property and
restore the ditch to its original position and contours, I would like to request that you revisit the reclamation plan as it
relates to these requirements involving the Farmers Ditch. The report I sent you concludes that the culvert has a
remaining life of only 3 to 7 years. Again, the position of the Farmers Ditch and the North Fork Lateral Ditch companies is
that they are seeking removal of the culvert and reconstruction of the open ditch as soon as possible. Whatever can be
done to expedite this reclamation would be most welcomed.
Please contact me if you need further information.
Thank you.
Steve Harper
Steven K.
