Environmental Protection Specialist Colorado Department of Natural Resources Division of Reclamation, Mining and Safety Office of Mined Land Reclamation 1313 Sherman Street, Room 215 Denver, Colorado 80203 Re: Permit No. M-1980-244; Cripple Creels & Victor Gold Mining Company ("CC&V"); Cresson Proiect — Written Spill Notification — Processed Ore Thickener Overflow Tank Spill — October 25, 2017 Dear Mr. Cazien In accordance with Rule 8, Section 8-2.3 of the Mineral Rules And Regulations of the Colorado Mined Land Reclamation Board For Hard Rock, Metal, And Designated Mining Operations (Rules), the Cripple Creek and Victor Gold Mining Company (CC&V) hereby provides the Division of Reclamation, Mining and Safety (Division) with a formal report regarding the spill of neutral pH water from the Processed Ore Thickener Overflow Tank at the High Grade Mill (HGM), which occurred on the night of October 25, 2017. The following points address the requirements of Rule 8, section 8.2.3: a. Actions taken to respond to and correct the emergency situation or condition At approximately 10:00pm, Mill operators identified process water coming from the Processed Ore Thickener Overflow Tank. Process water was flowing out from the top of the overflow tank, into secondary containment. The secondary containment filled with process water from the tank overflow, eventually overtopping the walls of the secondary containment. Approximately 4,000-5,000 gallons of the neutral pH process water exited containment and onto the lined area adjacent to the containment (photo 1). • Mill operators noticed the pumps at the overflow tank were not operating properly at the time of the spill. It was determined that the system pump program was updated earlier in the day, consequently the overflow tank pump was not running in "auto". The operator switched the pump control to "auto", immediately stopping process water from flowing out of secondary containment. • The improvements made to the overflow pipe after the August 10"' spill prevented the processed water from splashing out of containment between the containment and the HGM. Two front end loaders were used to recover the saturated soil. The soil was removed using an `over - excavation' approach (photo 2). Depth of recovery was approximately six to twelve inches. 4
