Everist, Inc., 303-287-4656 <br /> Section 26, Twp 6 North, Rng 66 West, 6`h P.M., Weld County <br /> COMMENTS: The applicant has submitted a request for a partial acreage release for 61.07 of the 81.27 acres <br /> remaining in the permit area (9.36 acres were previously released). A total of 20.2 acres will remain within <br /> the permit boundary. <br /> L.G. Everist completed mining at the site in 2014. The portion of the site requested to be released consists of <br /> the West Lake (known by this office as the Everist Star Reservoir) and surrounding land, the west part of a <br /> parking area in the middle of the site, and the fully vegetated area on the north and east sides of the East <br /> Lake. The slurry wall liner for the Everist Star Reservoir (West Lake) was approved by this office as meeting the <br /> design standard in a letter dated December 16, 2014 and the lined portion of the site is now classified as a <br /> Lined reservoir. (A subsequent approval letter dated March 6, 2015 was issued to correct the WDID for the <br /> structure.) <br /> The 20.2 acres remaining in the permit boundary include the East Lake, the east part of the parking area, and <br /> an access road to reach the East Lake. A 6.1-acre portion of the East Lake has been determined to have been <br /> exposed to the atmosphere prior to January 1, 1981 and therefore does not require replacement of evaporative <br /> depletions. A 2.2-acre portion of the East Lake was exposed after December 31, 1980, and does require <br /> replacement of evaporative depletions. Depletions associated with the 2.2 "post-80" acres are included in and <br /> replaced under the L.G. Everist Combined Substitute Water Supply Plan (WDID 0202618), most recently <br /> approved February 10, 2016 for operation through December 31, 2017. The applicant must continue to be <br /> renewed on an annual basis until either a permanent plan for augmentation is obtained or the 2.2 acres is <br /> backfilled. <br /> Based on the above, this office has no objection to the partial acreage release request.
