All other conditions and requirements of Permit M1977-493 remain in full force and effect. <br /> Although the reclamation bond for the site will not be increased as a result of TR26 at this time, the wetland <br /> mitigation plan and the cost estimate for construction and monitoring of the Lake Irwin Wetland Mitigation <br /> Plan (as described in the Final Compensatory Mitigation and Monitoring Plan — Version 2.0) submitted as <br /> TR26 is now incorporated into the Climax Mine Reclamation Permit as a mine reclamation obligation. This <br /> work will be guaranteed financially by the Climax reclamation performance bond held by the Division. <br /> DRMS understands that Climax intends to begin Phase I wetland mitigation concurrent with OSF expansion <br /> activities beginning in summer of 2017 to avoid temporal loss of wetland functions. In the event that there is <br /> a default on completion of the wetland mitigation, the Division is authorized to make a claim against the <br /> reclamation bond to ensure that appropriate wetland mitigation is completed as described in TR26 and as <br /> required by the Section 404 permit issued by the US Army Corps of Engineers. <br /> If you have any questions,please contact me. <br /> Sincerely, <br /> Eric C.
