Colorado 80203 <br />RE: Request for Third Extension of Time to Address_ Partial Adeuuac� Review Comments for Chavers Mining <br />Resource DRMS Pennit No. M-3015-030 AM -1 <br />Dear Mr, Scott: <br />I am officially requesting that Asphalt Specialties Co., Inc. (ASCI), the applicant for the referenced permtt <br />amendment, be granted a third extension of time to effectively address several minor and one major adequacy <br />review issues from your Dec. 29, 2016 preliminary adequacy re%ieu and June 13, 2017 second adequacy rc%.ic«- <br />of the referenced application package. The slope stability study for approNal from CDOT to mine within 200 ft. <br />of their erosion control dikes on (lie Bradley property was submitted to CDOT on June 15. 2017 and was sent <br />out for revie" on June 31, 2017 to be done by the same CDOT person %% ho reviewed and approved the Chavers <br />slope stabilit} analysis in 3016. Peter Wayland did the slope stability analysis for this amendment as he had <br />done the one from last year as "ell. We have come up with sante results which would require a 50 -ft. setback <br />frotn the CDOT structures. We expect this review to be completed in mid-July. We are meeting with Anadarko <br />tomorrow morning to finalize an amended SUA with them and once that is dune, they will remote their <br />objection. The remaining issues in your June 13 adequacy review are pretty straightforward to explain or <br />correct. <br />ASCI is requesting another 30 -day extension of time from the original decision date of March 16, 3017 to <br />August 10,'_017 in order to complete the adequacy revieta approval process. <br />Please contact me for a confinnation of the new decision date and if there are any questions or concerns you <br />may have with this request for the added time extension <br />Sincerely, <br />Rob Laird <br />Resource Manager <br />cc: fife <br />
