ACCESS AGREEMENT <br /> This Agreement is entered into this /day of May, 2017, by and between EDWARD PINO <br /> (OWNER), whose address is 166 County Road 615, Walsenb Sa j� A e4 <br /> urg, Colorado 81089 and �� a <br /> COLORA.DO CRUSHING, INC.(HOLDER), whose address is 7707 3R Road, Beulah, <br /> Colorado 81023. <br /> 1. Owner grants, sells, and conveys to Holder the right of ingress and egress along an <br /> existing 2-track trail over Owner's property north and south along Owner's common <br /> boundary with Dennis and Ennis Perrino, and east and west along the north boundary of <br /> Owner's property running parallel with County Road 615 to County Road 614. The <br /> easement for such access granted by Owner shall be a 30 foot wide roadway over and <br /> across Owner's property as described above. The easement wilt be used for hauling of <br /> gravel and other Material in large trucks. <br /> 2. The term of this Agreement shall run for a period of fd{een (15)years commencin on <br /> the date the Holder has obtained all recess g <br /> �y govemrrzental approvals and permits <br /> Holder may terminate this Agreement upon thirty (30) days' notice to Owner. <br /> 3. Holder shall pay Owner the sum of <br /> $snooper year for up to 25,000 tons hauled <br /> across the easement. If Holder hauls more than 25,000 tons in a 12 month period, Holder <br /> shall pay Owner per ton for gravel hauled. The tonnage will be calculate <br /> d <br /> based on the scale weight of each load of gravel and Material hauled. <br /> 4. Owner shall have the right dung business hours and upon reasonable notice <br /> once per <br /> month to check the books and records of Holder for the purpose of verifying the amount <br /> hauled. <br />
