BEFORE THE MINED LAND RECLAMATION BOARD, <br />PRE -HEARING CONFERENCE OFFICER TONY WALDRON <br />PRE -HEARING STATEMENT OF SNOWCAP COAL COMPANY, INC. <br />IN THE MATTER OF OBJECTIONS CONCERNING TECHNICAL REVISION NO. 69 <br />TO PERMIT NO. C-1981-041 <br />PERMITEE: SNOWCAP COAL COMPANY, INC. <br />Permittee, Snowcap Coal Company, Inc. ("SCC") submits the following Pre -Hearing <br />Statement in the Matter of Objections to Technical Revision No. 69 to Permit No. C-1981-041 <br />and states as follows: <br />RELEVANT FACTUAL BACKGROUND <br />1. SCC is the current permittee under Permit No. C-1981-041 (the "Permit"), as revised, <br />which concerns reclamation of an underground coal mine located in Mesa County, <br />Colorado, known as the Roadside North and South Portal Mines (the "Roadside Portals"). <br />The Roadside Portals are located three miles northeast of Palisade in Mesa County on or <br />under lands located within portions of Sections 26, 27, 28, 34, and 35, Township 10 <br />South, Range 98 West, 6th P.M., and portions of Section 2, , Township 11 South, Range <br />98 West, 6th P.M.1 <br />2. The Division of Mining and Safety, Colorado Department of Natural Resources <br />("DRMS") holds a corporate surety performance bond of $805,952.60 associated with <br />SCC's obligations under the Permit. <br />3. On September 4, 2013 SCC submitted a Phase UII/III bond release application to DRMS <br />after completing certain reclamation work under the Permit (the "SL -8 Application"). <br />4. As part of the SL -8 Application process, SCC provided notice to landowners within and <br />adjacent to the mine permit area as required by 2 CCR 407-2:3.03.2(1). Rudolph <br />Fontanari, as the then current landowner within and adjacent to the permit area, raised a <br />number of issues and concerns regarding the SL -8 Application, including his concerns <br />about the potential for hydrologic communication from the lands overlying the <br />underground mine workings. The lands once owned by Mr. Fontaranari are now owned <br />by The Rudolph Fontanari, Jr. and Ethel Carol Fontanari Revocable Living Trust dated <br />June 18, 2008 ("Fontanari"). Mr. Fontanari is a Trustee for the Fontanari Trust. <br />1 The lands within the Permit boundary were revised pursuant to TR -67 <br />
