Box 191 <br />Victor, CO 80860 <br />www.newmont.com <br />Re: Permit No. M-1980-244: Cripple Creek _& Victor Gold Mining_ Comnanv ("CC&V" ): <br />Cresson Proiect; — Chicago Tunnel December 201_6 Inspection Response Rock Material <br />Sampling and Anal <br />Dear Ms. Eschberger, <br />Within the December 2016 DRMS inspection report received 9`h March 2017, it was found that <br />"The Operator has failed to follow the approved mining plan for this permit as revised by <br />Technical Revision No. 3 (TR -3). The Division's conditional approval of TR -3 required <br />geochemical analyses of material relocated from inside the adit to surface, as necessary to <br />determine whether the material is toxic or acid forming. The Operator has removed mine <br />development material from the adit and stockpiled it at the surface. However, the Division has no <br />evidence the Operator has conducted geochemical analyses of such material." <br />The inspection report required two corrective actions. The first, due 4.8117, is to sample rock <br />material removed from the Chicago Tunnel adit which is to be sent to a laboratory for analyses <br />of the material's toxic and acid producing capabilities. The second, due 717117, is to provide to <br />the Division the laboratory results of such analyses, include a report summarizing the results, <br />describing where the material will be moved to accordingly, and providing an estimated timeline <br />for completion. <br />The purpose of this correspondence is to demonstrate CC&V has completed the corrective <br />actions by collecting rock material samples and conducting proper chemical analyses. CC&V <br />believes this work demonstrates it is unlikely the rock material will adversely affect the <br />environment. <br />
