The 2015 Midterm Review Findings Document was dated <br />November 20, 2015 and emailed to Scott Cowman of Peabody Energy on December 1, 2015 from Janet Binns of the <br />Division. This Midterm Review identified three adequacy items, two of which were required to bring the C-1992-081 <br />permit up to date and in compliance. The MT -5 Findings identify a compliance date of January 29, 2016 to address the <br />Division's adequacy concerns. The MT -5 Findings document is attached for your reference <br />In addition, the Division completed a Reclamation Cost Estimate (RCE) of the remaining tasks associated with the HG <br />Loadout. The 2015 RCE was not processed by the Division as a Surety Increase (SI) or a Surety Reduction (SR). As <br />such, the Division has completed an UPDATED RCE to reflect costs which were updated on February 28, 2017. This <br />updated RCE is attached. <br />Based on a comparison with the currently approved required surety and the updated required surety, a Surety Reduction <br />may be required. <br />Please review the Division's update RCE attached and provide any questions or comments on the RCE. IF HG <br />Terminal, Inc. has no issues with the Division's estimate, a Surety Reduction of C-1992-081 will be processed <br />In addition, please review the MT -5 Findings and respond to the Division's adequacy comments as necessary.
