M-1990-041, MV-2016-055 <br /> C__ v <br /> "All of such civil penalty is suspended if Operator timely comply with the corrective actions set forth in <br /> this Order." <br /> • Compliance documentation that the Gilpin Mill is a historical site was hand delivered by Matt <br /> Collins and stamped January 27,2017 by Division of Reclamation Mining and Safety <br /> • George Otten called and spoke with Michael Cummingham on Tuesday,January 31,2017 <br /> regarding his submittal. Mr.Cummingham said that he had not read the whole document and <br /> would not read the whole document, but what he did read;it was not what they had asked for. <br /> Mr.Cummingham went on to say,that he would send a follow letter to George Otten and Matt <br /> Collins by Wednesday, February 2,2017 stating that we would have until February 27 to provide <br /> the additional documentation: 1) Document from the City of Blackhawk stating that the Gilpin <br /> Mill building was zoned as a historical site. 2) Document from the State of Colorado stating that <br /> the Gilpin Mill is designated a Colorado Historical Site <br /> • As of February 8,2017,George Otten and Matt Collins have not yet received a follow up letter <br /> from Michael Cunningham. George Otten called and spoke with Michael Cummingham on <br /> Wednesday, February 8,2017. Mr.Cunningham said,that he had read Mr.Otten entire's <br /> compliance documentation and reinstated that documentation did not provide what was <br /> requested. Again, Mr.Cummingham said,that he would send out a follow up to George Otten <br /> and Matt Collins on February 8 or 9 and also reinstated that George Otten has until February 27, <br /> 2017 to submit the additional documentation. It was asked,since Mr.Otten and Mr.Collins <br /> had not yet received the follow up letter, if the February 27 deadline could be extended? Mr. <br /> Cummingham stated,"No." It was a courtesy and he didn't have to extend the date until <br /> February 27. <br /> • As of today,Monday, February 13,2017—Mr.Otten and Mr.Collins have yet to receive a follow <br /> up letter from Mr.Cunningham. <br /> Information compiled by Sherry McDowell <br />
