Hays <br />Division of Reclamation, Mining & Safety <br />1313 Sherman Street, Room 215 <br />Denver, CO 80203 <br />Re: Permit No. M-1999-098 — Riverview Resource <br />,{ Corrective Action Response and Extension Request <br />Dear Peter: <br />9 <br />AGGREGATE <br />INDUSTRIES <br />The Division's December 7, 2016 report of its July 12, 2016 inspection noted two items <br />requiring action by Aggregate Industries, which are addressed below. <br />Availability of Records <br />The report states that there is a spillway in the southeast corner of Cell 3 that is not part of the <br />approved reclamation plan and that the reclamation plan must be updated to describe the <br />spillway by February 7, 2017. In discussing this with the contractor who installed this feature for <br />Aggregate, I was advised that this riprap channel was not installed as or intended to serve as an <br />engineered spillway but rather as a discharge point outfall. This discharge point is identified on <br />the currently approved Exhibit C Mining Plan map. <br />Water that is pumped from the northern portion of Cell 3 into a ditch along the east boundary of Cell 3 <br />flows south into the southern portion of Cell 3 before discharging to the Cache La Poudre River. Prior to <br />completing construction of the remainder of a dike in 2016 that divides Cell 3 into northern and southern <br />cells, water pumped from the pit was discharged to the river at a location west of the currently used <br />discharge point. That point is no longer used and when pumped water from the pit exceeds pond <br />capacity, the excess outflows to the river via the channel.
