Rd. 21 <br /> Haxtun CO 80731 <br /> Re: Elrich Pit, Permit M1997-015,Receipt of Incomplete 112 Construction Materials Reclamation Permit <br /> Application Package <br /> Mr. Schafer: <br /> On January 3, 2017, the Division of Reclamation, Mining and Safety received the 112 Construction Materials <br /> Reclamation Permit Application package for the Washington County Elrich Pit(M1997-015). Preliminary review of <br /> the information received determined that the following items must be received before the Division can consider your <br /> application as being submitted and technical review can begin: <br /> APPLICATION FORM: <br /> Pages 5 and 6"Responsibilities as a Permittee"must be initialed as appropriate. <br /> EXHIBITS: <br /> The primary deficiency with this amendment application is that it does not include the entire currently permitted <br /> area,or all of the currently disturbed area resulting from mining activity associated with this permit. An air photo <br /> depicting the areas that will need to be included, at a minimum,will be provided with this letter. DRMS encourages <br /> Washington County to establish an amended permit area that not only encompasses all existing permitted area and <br /> disturbances,but also a configuration that will be able to be adequately marked and maintained to prevent any <br /> boundary-related violations in the future. <br /> Because the proposed permit area as submitted is incomplete,DRMS will require re-submittals of Exhibits A,B,C, <br /> D,E,F, G,N, O and S as required by Rule 6.4 for this amendment. Exhibits Q and R were not provided with the <br /> submitted application package and will also need to be provided. <br /> Washington County will also be required to submit a new performance warranty for this amendment to be <br /> considered complete for filing. <br /> ADDENDUM 1-Notice Requirements-Affidavit of Posting Notice(Sign)(Rule 1.6.2(1)(b)): Prior to filing the <br /> application,post notices(signs) at the location of the proposed mine site, as required by the Office, of sufficient size <br /> and number to clearly identify the site as the location of a proposed mining operation giving name,address,and phone <br /> number of the Applicant, and stating that (name of Applicant) has applied for a mining permit with the Colorado <br /> Mined Land Reclamation Board. Anyone wishing to comment on the application may view the application at the <br /> County Clerk's or Recorder's office and should send comments prior to the end of the public comment period to the <br /> Colorado Mined Land Reclamation Office, at the address given on the cover of these Rules and Regulations. Any <br /> class of Limited Impact 110 or 110d operation need only post notice (sign) at the location of the proposed access to <br /> the site.
