Hope your New Year is going well. <br />Jason Musick said you had recently inquired about the status of Bowie Resources' application for Technical Revision <br />TR -110 for the Bowie No. 2 Mine. This is the revision application that proposes a gasification facility within the mine's <br />permit boundary. Jason is out of the office today, so in case he hasn't had a chance to get back to you, I thought I <br />would follow up. <br />Following the company's receipt of our 12/22/16 letter documenting our review of the application, the company asked <br />that the application be withdrawn. We received the company's request yesterday. Our Proposed Decision to Withdraw <br />the application was issued today (documents attached). We have asked the local newspaper to publish our Notice of <br />Proposed Decision as soon as possible. A comment period of 10 days (more if the 10th day falls on a weekend or a <br />Holiday) follows the publication of the NOPD. Assuming we receive no objections to our Proposed Decision, our <br />Proposed Decision will become Final following the close of the comment period. Because we have been asked to <br />withdraw the application, we will not be holding a public hearing regarding the application as had been requested. <br />If you have any questions today, please feel free to call me.
