Musick <br />Environmental Protection Specialist <br />Division of Reclamation, Mining and Safety <br />1313 Sherman St., Room 215 <br />Denver, Colorado 80203 <br />wED <br />DEC 27 2016 <br />Division of &ecla Reclamation, <br />Mining Y <br />Re: Bowie No. 2 Mine (Permit No. C-1996-083), 'Technical Revision No. 110 (TRA 10), Installation of <br />gasification plant within the permit (HC #67452) <br />Dear Mr. Musick: <br />Thank you for your correspondence dated November 23, 2016 (received by our office on December 2, 2016) <br />regarding the above referenced technical revision. <br />After review of the documentation provided including supplemental information received by our office on <br />December 20, 2016, it is our opinion that the proposed activities will result in no historic properties affected as <br />per 36 CFR 800.4(4)(1). This finding is based on the results of the 1996 identification survey within the project <br />footprint as documented by Cultural Re ourere Inventory Report for the Proposed Bowie #2 Mine, Delta County, Colorado as <br />well as the level of current ground disturbances therein. <br />Should unidentified archaeological resources be discovered in the course of the undertaking, work must be <br />interrupted until the resources have been evaluated in terms of the National Register eligibility criteria (36 CFR <br />60.4) in consultation with our office pursuant to 36 (FR 800.13. also, should the consulted -upon scope of the <br />work change please contact our office for continued consultation under Section 106 of the National Historic <br />Preservation Act. <br />We request being involved in the consultation process with the local government, which as stipulated in 36 CI'R <br />8003 is required to be notified of the undertaking, and with other consulting parties. additional information <br />provided by the local government or consulting parties might cause our office to re-evaluate our eligibility and <br />potential effect findings. Please note that our compliance letter does not end the 30 -day review period provided <br />to other consulting parties. <br />Thank you for the opportunity to comment.
