The Proposed Decision documents lite applicant's compliance with the approved Colorado <br />regulatory program at Rule 3.03.2. <br />This 448A acre Phase III bond release applies to portions of lite Trapper Mine south of Craig, Colorado, <br />which were reseeded in the 2001— 2005 timeframe. OSMRE and the Bureau of Land Management <br />participated in the bond release inspection held on July 6, 2016. By letter, dated December 2, 2016, the <br />BLM provided its concurrence with clic SL -17 bond release (attached). OSMRE interprets the BLM's <br />concurrence to mean that Trapper is in compliance with all BLM coal Icase stipulations. <br />OSMRE agrees with DRMS that Trapper has met or exceeded the requirements for Phase Ili bond release <br />on the 448.4 acres of land as described in DBMS Proposed Decision document. The Division currently <br />holds a performance bond in the amount of $23,400,000.00 for the Trapper Mine. DBMS proposes to <br />release $659,843.13 with this bond release action. OSMRE agrees with the findings and decision <br />document and hereby provides OSMRE concurrence for the above bond release action in accordance with <br />30 CFR 740.15 (d) (3), and 30 CFR 906.30, Article IX, Section 24, of the State-Fedcral Cooperative <br />Agreement. <br />Thank you and your staff for coordinating this Federal mine bond release action through the DFD.
