Mr. Hays:
Please find enclosed all content requested in an Adequacy Review letter dated
November 28, 2016. Following is a summary of enclosed items as requested.
1.6 Public Notice
1. As required by Rule 1.6.2(d) and 1.6.5(2),proof of publication by affidavit from
the "REPORTER-HERALD", is enclosed.
2. As required by Rule 1.6.2(e),please find enclosed Certified Mail receipts from
the U.S. Postal Service as proof of the notice to all owners of record of surface
and mineral rights of the affected land and the owners of record of all land surface
within 200 feet of the boundary of the affected land including all easement
holders located on the affected land and within 200 feet of the boundary of the
affected land.
3. Loveland Ready-Mix Concrete, Inc. will maintain the existing augmentation plan
as decreed in Division 1 Water Court case no. 2009CWI05. Should the need arise
for another permit; a formal permit application will be filed. Loveland Ready-Mix
Concrete, Inc. will also follow requirements under CRS 24-80 part 13 if any
possible cultural resources are uncovered.
6.4.5 Exhibit E—Reclamation Plan
4. The text"A copy of the approved USR amendment will be provided when
available"has been added to page 11 of 39 of the permit application. Enclosed is
the replacement sheet 11.
6.4.12 Exhibit L—Reclamation Costs
5. Loveland Ready-Mix Concrete, Inc. agrees with the Divisions bond estimate and
adopts the estimate as part of the application. Pages 21 and 22 of 39 shall be
replaced with the attached AMND 21 of 39 and AMND 22 of 39.
