" 70N <br />Dear Mr. Bowles: <br />Tri-State Generation and Transmission Association, Inc. (Tri-State) has received your <br />adequacy review letter for SL -18 dated August 30, 2016, and provides the following responses to <br />your comments on behalf of the Elk Ridge Mining and Reclamation, New Horizon Mine. <br />1. Comments were received from Ms. Turner in a fax dated April 16, 2016 Ms. Turner's <br />comments were largely centered on the theme that `haul roads should not have a ten year <br />bond period in a farming community.' The Division replied to Ms. Turner's comments in <br />a May S, 2016 letter. Although the Division did not agree with Ms. Turner's <br />interpretation of the haul road Rules, it did recognize that requiring the NE Haul to go <br />through the 10 year liability period could create an obstacle to a landowner managing <br />their property. A meeting was held with Ms. Turner to discuss options. The Division <br />proposed that the NE Haul Road can remain as a permanent feature giving vehicle <br />access to farmer's property and can then be released with the adjoining property during <br />the upcoming Phase III bond release. Ms. Turner felt this was an adequate solution. The <br />NE Haul Road is being requested as a permanent feature in TR -75. <br />Response: The Division is correct that the NE Haul Road is being requested to be retained as a <br />permanent feature under TR -75. TR -75 is still under review by the Division. <br />2. A section of the BB Detour Road, north of the BB Road has not been fully reclaimed. <br />This section of the road provides access to the CCC ditch headgate, is surfaced with <br />asphalt and crosses two properties, WFC and Richards. It is unclear in the permit if the <br />property owners want this section of the road to remain in place and surfaced with <br />asphalt. Please provide letters from the landowners stating that the headgate access <br />road can remain in its current configuration. <br />Response: Letters have been obtained from Richards and Kirkwood indicating that retention of <br />the road to the CCC ditch headgate is to remain as a permanent feature on their respective <br />properties. Both surface owner consent letters have been submitted within this adequacy <br />response to document their requests under the SL -18 bond release application.
