Musick <br />Environmental Protection Specialist ONNAWN OF RECLAMATION <br />Division of Reclamation, Mining and Safety- MUNGAl.'D SAFE <br />1313 Sherman St., Room 215 <br />Denver, Colorado 80203 <br />Re: I3owie No. 2 Mine (Permit No. C-1996-083), Technical Revision No. 108 (IR -108), Delete 19 Series G\'Bs <br />and Technical Revision No. 109 (TR -109), Expand Pond J to the \Fest (IIC #67452) <br />Dear Mr. Musick: <br />"Thank you for your correspondence dated August 31 and September 14, 2016 (received by our office on <br />September 6 and September 16, 2016 respectively) regarding the above referenced technical revisions. <br />After review of the documentation provided including supplemental information received by our office on <br />September 27, 2016 it is our opinion pursuant to 36 CFR 800.3(a)(1) that'I'R-108 is an undertaking that has no <br />potential to cause effects on historic properties while TR -109 will result in no historic properties affected as per <br />36 CFR 800.4(d)(1). <br />Should unidentified archaeological resources be discovered in the course of the undertaking, work must be <br />interrupted until the resources have been evaluated in terms of the National Register eligibility criteria (36 CFR <br />60.4) in consultation with our office pursuant to 36 CI,R 800.13. Also, should the consulted -upon scope of the <br />worn: change please contact our office for continued consultation under Section 106 of the National Historic <br />Preservation Act. <br />\t'e request being involved in the consultation process with the local government, which as stipulated in 36 CI 'R <br />800.3 is required to be notified of the undertaking, and with other consulting parties. Additional information <br />provided by the local government or consulting parties might cause our office to re-evaluate our ehgibiht}' and <br />potential effect findings. Please note that our compliance letter does not end the 30 -day review period provided <br />to other consulting parties. <br />Thank you for the opportunity to comment.
