DFD agrees with the findings and decision document and hereby <br />provides OSMRE concurrence with the above bond release action in accordance with 30 CFR <br />740.15 (d) (3), and 30 CFR 906.30, Article IX, Section 24, of the State -Federal Cooperative <br />Agreement. <br />DRMS's Proposed Decision documents the applicant's compliance with the approved Colorado <br />regulatory program at Rule 3.03.2. This bond release application originally requested 33.0 acres <br />for Phase I release, 49.4 acres for Phases I & II release, and 1 acre plus 185 sealed drill holes for <br />Phases I, II, and III release. DRMS has determined that a total of 82.93 acres are eligible for <br />Phase I release, 45.33 acres are eligible for Phase II release, and 4.1 acres are eligible for Phase <br />III release. <br />DRMS conducted the bond release inspection on August 4 & 5, 2015. Representatives from the <br />Bureau of Land Management, the United States Forest Service, and OSMRE attended. By letters <br />dated August 22, 2016, the Bureau of Land Management and the United States Forest Service <br />provided concurrence with DRMS's proposed decision to approve this bond release action <br />(attached). OSMRE interprets these concurrence letters to mean that Bowie Resources, LLC is in <br />compliance with all applicable coal lease stipulations for its Bowie 42 Mine. <br />OSMRE agrees that Bowie Resources, LLC has met or exceeded the requirements for Phase I, II, <br />and III bond release as noted in DRMS's proposed decision and findings of compliance dated <br />July 25, 2016. DRMS proposes to release $1,475,642.03 under the SL -1 bond release action. <br />OSMRE concurs with this decision. <br />
