Fbert <br />Environmental Protection Specialist <br />Division of Reclamation, Nfinmg and Safety <br />Department of Natural Resources <br />1313 Sherman Street, Room 215 <br />Denver, Colorado 80203 <br />RECEIVED <br />ASG � 8 2016 <br />()tviston of Radamation, <br />Musing & Mehl <br />Re: I'oidel Creek Mine (Permit No. C-1982-056), Technical Revision No. 84 (TR -8.1), 6NIN Passive Water <br />Treatment System, Colorado (HC #67400) <br />Deal- Mr. Ebert: <br />We received your correspondence dated Jule 29, 2016 on August 5, 2016 regarding the proposed undertaking <br />referenced above. <br />Following our review of the available documentation including the report titled Txentymile (-.'oal, LLC- .,1 Clasr <br />Cultural Resources Int,entor), of the Proposed 6MN Rerer7,oirand ll%'ater7reaownt _Area, Routt County, Colorado and the <br />Foidel Creek Mine Surface Facility Map (24) it is our opinion that a finding of no historic properties affected <br />[36 CFR 800.4(d)(1)J is appropriate for the proposed undertaking. This determination is based on the <br />negative results of cultural resources within the undertaking's area of potential effects. <br />Should unidentified archaeological resources be discovered in the course of the project, work must be <br />interrupted until the resources have been evaluated in terms of the National Register eligibility critena (36 CFR <br />60.4) in consultation with our office pursuant to 36 CFR 800.13. Also, should the consulted -upon scope of the <br />work change please contact our office for continued consultation under 36 CFR part 800. <br />The consultation process does involve other consulting parties such as local governments and Tnbes, which as <br />stipulated in 36 CFR 800.3 are required to be notified of the undertaking. Additional information provided by the <br />local government, Tribes or other consulting parties map cause our office to re-evaluate our comments and <br />recommendations. <br />\Ve thank you for the opportunity to comment.
