(Tri-State) has received Mr. Jared <br />Ebert's completeness letter for SO -02 dated July 28, 2016, and provides the below responses on <br />behalf of Elk Ridge Mining and Reclamation, LLC New Horizon North Mine. The New Horizon <br />Mine operates under Permit No. C-1981-008. <br />1.) The application submitted with the proposed permit transfer is the incorrect form. The <br />correct application for a Request for Transfer of Coal Permit and Succession of Operators <br />is on the Division's website <br />http://mining.state.co.us/SiteCollectionDocumentslsuccession.pdf. Please fill out the <br />application in full and submit it to the Division in accordance with Rule 2.08.6(2)(b). <br />Response: The Transfer of Coal Permit and Succession of Operators form has been <br />submitted herein accordingly. <br />2.) The requirements of the public notice for the SO2 application is discussed in section <br />2.08.6(3) of the rules and regulations. Please revise the proposed public notice to indicate <br />the address of the original permittee. If this address is the same as the proposed successor <br />permittee address, you may simply indicate that on the proposed public notice. <br />Response: The public notice has been updated with a statement indicating the successor <br />permittee address is the same as the current permittee as requested. A revised version has <br />been included for your review. <br />2.) The cover letter with the application indicates that Tri-State will update the Self Bond SB - <br />003 during the next bond renewal process. In order for the Division to approve the <br />Succession of Operators application, the Self Bond will need to be updated now for the new <br />permittee in accordance with Rule 2.08.6(2). Please submit a new bond document and <br />indemnity agreement. The Self Bond document can be found on the Division's website, <br />http://mining.state.co.usISiteCollectionDocuments/sfbondagreement.pdf. The indemnity <br />agreement is not on the Division's website.
