By order entered on July 8, 2016 (the "Approval Order"), the United States Bankruptcy Court for <br />the Eastern District of Missouri (the "Court") approved the Disclosure Statement filed by Arch Coal, Inc. and its <br />subsidiaries that are debtors and debtors in possession (collectively, the "Debtors") and directed the Debtors to solicit <br />votes to accept or reject the Debtors' Third Amended Joint Plan of Reorganization Under Chapter 11 of the Bankruptcy <br />Code (as the same may be updated, supplemented, amended and/or otherwise modified from time to time, the "Plan" ),2 <br />annexed as Exhibit A thereto. <br />2. The Approval Order establishes July 6, 2016 as the Voting Record Date for determining the holders of <br />pre -chapter 11 claims entitled to vote on the Plan and establishes 11:59 p.m. (prevailing Central Time) on August 31, <br />2016 as the Voting Deadline for the submission of ballots to accept or reject the Plan (the "Ballots"). <br />3. Holders of claims entitled to vote on the Plan will receive electronic copies on CD-ROM or USB flash <br />drive of (i) the Approval Order, the Disclosure Statement, the Plan and certain exhibits thereto, (ii) this notice and (iii) a <br />Ballot or Beneficial Ballot, as appropriate, together with a pre -addressed postage pre -paid envelope to be used in voting <br />to accept or to reject the Plan. Failure to follow the instructions set forth on the Ballot or Beneficial Ballot, as <br />applicable, may disqualify that Ballot or Beneficial Ballot and the vote represented thereby. <br />4. Holders of claims or interests that are either unimpaired or fully impaired, who in each case are not <br />entitled to vote on the plan, will receive this notice and a Non -Voting Notice, together with a pre -addressed postage pre- <br />paid envelope to be used by those holders electing to opt out of the releases described in Section 11.8 of the Plan. <br />Failure to follow the instructions set forth on the Non -Voting Notice may result in the election to opt out of granting the <br />release provisions being disqualified. <br />5.
