Review of this application determined the following items must be received before <br />the Division can consider the application as being submitted and the technical review can begin. Please <br />respond to this Incomplete Application Letter with the requested additional/updated information on permit <br />replacement pages and summarize each response in a cover letter titled “Response to Incompleteness; M- <br />2009-010; CN-01”. <br /> <br />APPLICATION FORM <br /> <br />1. The first page of the application lists 10 acres as existing permitted acres at the site. The Stewart Pit <br />II has been approved for 9.0 acres. Please update this field and submit a replacement page 1 of the <br />Application Form; this will likely change the “Change in Acreage (+)” field as well. <br /> <br />EXHIBIT A - Legal Description (Rule 6.4.1): <br /> <br />2. The legal description listed in Exhibit A may contain an error. The Division believes the Applicant <br />intended to state the NE ¼ of the SE ¼ of Section 6 instead of the “NE ¼ AND SE ¼ Section 6”; <br />additionally, it appears that the location of the site and proposed expansion might be more accurately <br />described as the E ½ of the SE ¼ of Section 6. Furthermore, the coordinates provided in Exhibit A <br />regarding the location of the site entrances appear to have been formatted incorrectly. An example of <br />the standard Degrees Minutes Seconds format is 39°12’17.9” N instead of 39’12179 N. Please make the <br />necessary changes and submit a replacement Exhibit A. <br /> <br />EXHIBIT B - Index Map (Rule 6.4.2): <br /> <br />3. The index map submitted in Exhibit B fails to show the regional location of the affected land and all <br />roads and other access to the area.
