<br /> <br /> <br /> <br /> <br />1313 Sherman Street, Room 215 <br />Denver, Colorado 80203 <br /> <br />June 21, 2016 <br /> <br />Justin Kuntz <br />Tim & Justin Kuntz Trucking, LLC <br />53596 CR ZZ <br />Yuma, CO 80759 <br /> <br />Re: Technical Revision Adequacy Review; <br /> Fryrear Gravel Pit; Permit No. M-1998-071; TR-01 <br /> <br />Dear Mr. Kuntz, <br /> <br />The Division of Reclamation, Mining and Safety (Division) has reviewed the content of the request for a <br />Technical Revision (TR-01) for the Fryrear Gravel Pit, File No. M-1998-071, and submits the following <br />comments. The Division is required to make an approval or denial decision no later than July 1, <br />2016; therefore, a response to the following adequacy review concerns should be submitted to the <br />Division as soon as possible. In order to allow the Division adequate time to review your responses to <br />any adequacy issues, please submit your adequacy responses to the Division no later than June 30, 2016. <br /> <br />The review consisted of comparing the Technical Revision content with specific requirements of Rules <br />1, 3, 6.1, 6.2, and 6.4 of the Minerals Rules and Regulations of the Colorado Mined Land Reclamation <br />Board for the Extraction of Construction Materials. Any inadequacies are identified below. <br /> <br />1. The Division has reviewed the content of the approved Amendment 1 and the size of Tracts 1-4 <br />are 10 acres each. This Technical Revision proposes to add Tracts 5 and 6 within the affected <br />land/permit boundary. These two additional tracts should total 40 acres in size, but the Division <br />doesn’t have information on the size of each new tract individually. Please identify the size of <br />the two additional Tracts. <br /> <br />2. As proposed in TR-01, the Operator requests to have an active mining face as part of this <br />operation instead of committing that all slopes on the site would be 3H:1V or flatter. This active <br />mining face will be no taller than 25 feet and no longer than 300 feet. The Division has <br />completed the Financial Warranty calculation for the additional reclamation cost of the new task <br />to grade the active mining face to 3H:1V The additional reclamation cost estimate has been <br />calculated in the amount of $1,900.00. Please review the enclosed reclamation cost estimate <br />task sheets as soon as possible and contact our office if you have any questions or if you find any <br />calculation errors. When TR-01 is approved, the Division will issue a Surety Increase, giving the <br />Operator 60 days from that date to post the additional Financial Warranty. <br /> <br />This concludes the Division’s adequacy review of this Technical Revision. This letter shall not be <br />interpreted to mean that there are no other technical deficiencies in your request. Other issues may arise <br />as additional information is supplied.
